Toronto Canada Pension Plan Disability (CPPD) Benefits Lawyers

Canada Pension Plan Disability (CPPD) benefits are generally available to Canadians who cannot work due to an injury or illness. However, for a variety of reasons, CPPD benefits are often paid at a lower rate than one expects, for a shorter period of time than is needed or are denied altogether.

At CHAGPAR LAW, Salina F. Chagpar and our experienced team of Litigation Lawyers are focused on helping clients with long-term disability claims. As part of this process, we act as steadfast representatives for clients through the application, reassessment and appeals process for CPPD. We know that some conditions, such as chronic pain and mental illness, are difficult to explain to an outside party and the process of having to fight for benefits can compound the existing stress on our clients and their families.

Walking Clients Through the Steps of a CPPD Appeal

Once CPPD benefits are denied, there are several stages to appeal. If a claimant is successful at any level, he or she need not proceed to the next one. Our experience over the years shows that the long-term disability and CPPD process can be complicated, time consuming and requires skilled advocacy to reach a successful result through the various forums of hearings. The stages are:

  • Asking Service Canada to reconsider its decision
  • Asking the Office of the Commissioner of Review Tribunals (OCRT) to review the Service Canada reconsideration
  • Asking the Pension Appeals Board to review the OCRT decision

In order to be allowed an appeal, a request must be filed within 90 days of receiving written notice of a decision. At CHAGPAR LAW, we handle this paperwork for clients and speak on their behalf at appeal proceedings as part of their long-term disability claim. Our work necessarily includes extensive consultation with clients during which we seek to understand their personal needs and how we can properly express their experiences to a government body. We retain the necessary medical experts to support your claim. We have the experience that gets re$ults.
